Why Hate Speech is Not Free Speech

Freedom in a free society is supposed to be for all. Therefore, freedom rules out imposing on the freedom of others. You are free to walk down the street, but not to keep others from doing so.

The imposition on the freedom of others can come in overt, immediate physical form — thugs coming to attack with weapons. Violence may be a kind of expression, but it certainly is not “free speech.”

Like violence, hate speech can also be a physical imposition on the freedom of others. That is because language has a psychological effect imposed physically — on the neural system, with long-term crippling effects.

Here is the reason:

All thought is carried out by neural circuitry — it does not float in air. Language neurally activates thought. Language can thus change brains, both for the better and the worse. Hate speech changes the brains of those hated for the worse, creating toxic stress, fear and distrust — all physical, all in one’s neural circuitry active every day. This internal harm can be even more severe than an attack with a fist. It imposes on the freedom to think and therefore act free of fear, threats, and distrust. It imposes on one’s ability to think and act like a fully free citizen for a long time.

That’s why hate speech imposes on the freedom of those targeted by the hate. Since being free in a free society requires not imposing on the freedom of others, hate speech does not fall under the category of free speech.

Hate speech can also change the brains of those with mild prejudice, moving it towards hate and threatening action. When hate is physically in your brain, then you think hate and feel hate, you are moved to act to carry out what you physically, in your neural system, think and feel.

That is why hate speech in not “mere” speech. And since it imposes on the freedom of others, it is not an instance of freedom.

The long–term, often crippling physical effects of hate speech on the neural systems of those hated does not have status in law, since our neural systems do not have status in our legal system — at least not yet. This is a gap between the law and the truth.

Jennifer, You are right it would be wrong to ban hate speech! After reading Professor Susan Benesch- Understanding Dangerous Speech, I see the term Hate speech just to broad and open to many interpretations.
So here I go again it figures Im quoting another university professor, but relax jennifer this ones not from UC Berkly This professor devotes her life to countering dangerous speech. She can’t ignore Donald Trump’s.
Understanding Dangerous Speech
–What is Dangerous Speech?

Dangerous Speech is any form of expression (speech, text, or images) that can increase the risk that its audience will condone or participate in violence against members of another group. We have observed striking similarities in the rhetoric that leaders use to provoke violence in completely different countries, cultures, and historical periods. One of these rhetorical ‘hallmarks’ or recurring patterns in Dangerous Speech is dehumanization, or referring to people in another group as insects, despised or dangerous animals, bacteria, or cancer. More hallmarks are listed below.

Rhetoric alone can’t make speech dangerous, though; the context in which it is communicated is just as important. One can capture that context, and analyze speech for dangerousness, by asking about five aspects of the speech:

•Speaker: Did the message come from an influential speaker?


•Audience: Was the audience susceptible to an inflammatory message, e.g. because they were already fearful or resentful?


•Message: Does the speech carry hallmarks of Dangerous Speech? The hallmarks are:

•Dehumanization. Describing other people in ways that deny or diminish their humanity, for example by comparing them to disgusting or deadly animals, insects, bacteria, or demons. Crucially, this makes violence seem acceptable.


•‘Accusation in a mirror.’ Asserting that the audience faces serious and often mortal threats from the target group - in other words, reversing reality by suggesting that the victims of a genocide will instead commit it. The term ‘accusation in a mirror’ was found in a guide for making propaganda, discovered in Rwanda after the 1994 genocide. Accusation in a mirror makes violence seem necessary by convincing people that they face a mortal threat, which they can fend off only with violence. This is a very powerful rhetorical move since it is the collective analogue of the one ironclad defense to murder: self-defense. If people feel violence is necessary for defending themselves, their group, and especially their children, it seems not only justified but virtuous.


•Assertion of attack on women/girls. Suggesting that women or girls of the audience’s group have been threatened, harassed, or defiled by members of a target group. In many cases, the purity of a group’s women is symbolic of the purity of the group itself, or of its identity or way of life.


•Coded language. Including phrases and words that have a special meaning, shared by the speaker and audience. The speaker is therefore capable of communicating two messages, one understood by those with knowledge of the coded language and one understood by everyone else. This can make the speech more dangerous in a few ways. For example, the coded language could be deeply rooted in the audience members’ sense of identity or shared history and therefore evoke disdain for an opposing group. It can also make the speech harder to identify and counter for those who are not familiar with it.


•Impurity/contamination. Giving the impression that one or more members of a target group might damage the purity or integrity or cleanliness of the audience group. Members of target groups have been compared to rotten apples that can spoil a whole barrel of good apples, weeds that threaten crops, or stains on a dress.



•Context: Is there a social or historical context that has lowered the barriers to violence or made it more acceptable? Examples of this are competition between groups for resources and previous episodes of violence between the relevant groups.


•Medium: How influential is the medium by which the message is delivered? For example, is it the only or primary source of news for the relevant audience?


All five conditions need not be relevant, for speech to be dangerous. For example, a message can be dangerous even when the speaker is anonymous. Only two of the conditions are necessary: the message must be inflammatory, and the audience must be susceptible. Wow, hard to keep up with you Thought Police. So now there's not only "Hate Speech", but there's "Dangerous Speech" which encompasses just about anything anybody (no, just your political enemies) says to anyone at any time and any place. And Linguistics Professors are in charge of interpreting our speech and deciding what is and is not 'Dangerous Speech'.

What's next? Dangerous Thought Patterns?

Just think - if you guys could put a chip in everyone's (not everyone, just Southerners and Republicans) brain to see what we're all thinking, and then pass laws on thought patterns, maybe you could actually throw us all in jail or put us in some kind of camp or how about sterilize us. A lobotomy might work.

How did you know?
jennifer I was sent to the 8th Army stockkade Ascom Korea in 1968 for refusing
change of duty station, I was 17 at the time put in solitary and resricted diet, Just enough to keep you alive.
First time ever in Jail, It was very hard, So freaken hungry and cold. Ate tooth paste, Cold Dark hungray like you dont know!
We had whats called I G inspection at stockade, I G stands for inspection General. A 3 Star general asked me why I was in solitary, I told him for refusing duty change, He commented back if you didnot act like an animal you would not be here.
At that point I responded, Let me the fug out of here and I will walk across that bridge and you will never see me again. The duty station change was to Vietnam and after Ascom I was draged to Kimpo airbase and flowm to Vietnam to begin my rehabilitaion. How did you know Jennifer?
On the subject of hate and dangerous speech- Do you think there is Dangerous speech that incites violence? Thats the point Im trying to make when I say dangerous speech. Words can be used to incite violence, And when words are used for that reason, Just maybe we laws to curb it.
But it seems you dont think so or do you believe such a thing as dangerous speech exist?

I know of another GI who did just that, three years later they say he drowned while out swimming with friends. Im gratful the General did not open my cage,
because I would have ran across that bridge in 68.

I think 'speech' - words or phrases that someone says to someone else causes violence, yes. Like if two guys are out at a bar, and one calls the other names or threatens him, whatever, his words cause violence and they're fighting. What someone says can cause violence.

Now we're supposed to examine with a fine tooth comb what we're going to say before we say it to determine if it's 'dangerous speech' if someone doesn't like what we say or if what we say is going to affect someone's brain neural pathways or whatever they're called.

And if we say something and someone freaks out and goes and does something stupid, that's our fault and we go to jail for breaking the 'dangerous speech' law. We're the ones at fault, not the perpetrator. Yeah, I want to live in that world.
