Lawyer Willing to Represent Families of Covington HS Students Pro Bono

One lawyer said Wednesday on Fox & Friends that he's willing to represent the families of some Covington High School students pro bono.

Many online were quick to criticize the students from the Kentucky high school following the viral confrontation involving them and a Native American protester over the weekend.

The students were initially believed to be harassing the protester, Nathan Phillips, following the March for Life rally in Washington, D.C.

Subsequent video footage, however, revealed that the students were accosted and yelled at before Phillips and other Native American activists approached them. Another group -- the so-called Black Hebrew Israelites -- were heard shouting abuse at the students for wearing “Make America Great Again” hats.

Many people called for the students to have their private information revealed on social media, and a freelance journalist even wished death on the students.


Attorney Robert Barnes said that he represents families of students who were libeled, families of some children featured in photos of the encounter and alumni who want to seek legal remedy as well.

"A lot of these journalists that have been saying false statements about these kids ... all you have to prove is that they were negligent in doing so, and by this standpoint, by this point in time, it is clear that anyone who continues to lie and lie about these kids has done so illegally and can be sued for it," he said.

Barnes said that legal fees in libel lawsuits can amount to nearly $1 million in some cases, so he wanted to "equalize the playing field" in the case of some students.

He announced Wednesday that potential defendants are being given a 48-hour notice to retract and correct any false statements about these Covington students.

"If you have said anything false about these kids, they are willing to extend you a 48-hour time period -- a period of grace, consistent with their Christian faith -- for you to, through confessions, get redemption and retract and correct and apologize," Barnes said.

He also explained that plaintiffs are allowed to seek "per se damages" in libel lawsuits, meaning that individual damages do not have to be proven.

"Those damages can range from $50,000 to $300,000 to, in the Gawker case, millions and millions of dollars," he said. "So all these people that have lied and libeled better be checking their bank accounts if they're going to continue to lie and libel of these kids."

Barnes added that he was especially disappointed that New York Times White House correspondent Maggie Haberman has yet to retract her statements made about the confrontation.

So the Covington victims have hired another lawyer - a great one! I hope they sue the pants off everyone who was complicit in ruining these kids' lives. Should be taking Nathan Phillips to the cleaners. He's a lying sack of cr*p.

Nick Sandmann's family hires attorney who has handled lawsuits against media outlets

In a news release sent by the Hemmer DeFrank Wessels law firm, the family announced it has hired L. Lin Wood of Atlanta.

"...Todd McMurtry, the family’s legal counsel, conducted an extensive search to find a nationally-recognized attorney skilled in the fields of libel, defamation, and the First Amendment," the release said.

Wood represented JonBenet Ramsey's brother in a $750 million defamation suit against CBS. The suit accused CBS of ruining Burke Ramsey's reputation after a television series suggested he killed his 6-year-old sister more than two decades ago.

The terms of the settlement, which was reached earlier this month, were not disclosed.

McMurtry, a Covington resident, will continue to serve the family as co-counsel.

"Mr. Wood brings an unrivaled record of success in the courtroom, having represented such clients as the family of JonBenet Ramsey, former Rep. Gary Condit and Richard Jewell in lawsuits against the media," McMurtry wrote.

"Mr. Wood visited with the family today in northern Kentucky. He is committed to bringing justice to 16-year-old Nick Sandmann and his family. Further announcements should be expected in the next few days."

Wood also represented family of Richard Jewell in a libel case against The Atlanta Journal-Constitution, according to the Reporters Committee for Freedom of the Press.

After the 1996 Olympic Park bombing, Jewell was wrongly accused.

In 2011, The Washington Post described Wood as an attorney who has "carved out a successful career representing the high-profile and falsely accused, often seeking eye-popping damages for those he believes have been libeled or slandered in the press."

When asked if the announcement signals the Sandmann family is considering a suit against media outlets, McMurtry replied by email: "The Sandmann family has no further comment this evening other than to say all options are on the table."

Nick Sandmann's lawyer announces serious action against Nathan Phillips

An attorney representing Nick Sandmann, the 16-year-old student from Covington Catholic High School in Kentucky who became the center of political controversy last month, have announced legal action against Nathan Phillips, the Native American man who Sandmann and his classmates were accused of mocking.

What are the details?

Atlanta-based lawyer L. Lin Wood, who is known for winning defamation cases, told LifeSiteNews that Phillips will be sued for his "lies and false accusations" against Sandmann and the Covington students, which he said are "well documented."

Wood said the first round of lawsuits would be filed within two weeks.

Sandmann's legal team sent legal notices to more than 50 journalists, media personalities, Hollywood celebrities, media organizations, and Catholic organizations on Feb 1, notifying them that they could potentially be sued for defaming Sandmann. Those entities, the lawyers allege, propagated a false narrative that accused Sandmann and Covington students of mocking Native Americans in Washington, D.C., last month.

In the letters, the lawyers requested any evidence pertaining to Sandmann, Covington, and the overall incident be preserved for future use in legal proceedings.

On the onset, the list of potential legal targets was set at 54. But Wood told LifeSiteNews that number "continues to grow," explaining Sandmann's team of lawyers is "in the process of sending formal written retraction demands in conformity with statutes in states in which litigation may be filed."

Wood further confirmed on social media Friday that Phillips "will be sued."

Anything else?

Woods also confirmed the Diocese of Covington continues to investigate the Washington incident involving Covington students, although he does not know why.

He told LifeSiteNews:

We have no idea why the investigation by the Diocese has not been concluded but we are confident that any objective review of the evidence will conclude that Nick did nothing wrong. Nick remained calm and well-mannered despite being confronted by an activist beating a drum within inches of his face while chanting loudly. Nick did not utter one word except to quietly urge a classmate to refrain from making any comments that might aggravate the situation created by Phillips and the Black Hebrew Israelites.

Wood released a 14-minute video last week showing the narrative arc of the Covington controversy, beginning with the disinformation campaign parroted by the mainstream media to the actual truth of what happened on the steps of the Lincoln Monument.
