The Coronavirus Is Exposing Little Tyrants All Over The Country

Some mayors and governors seem to think their authority is limitless in the face of the pandemic. They need a remedial lesson in the Constitution.

There’s nothing like a crisis to bring clarity. The response of some mayors and governors to the coronavirus pandemic in recent days has made it clear they think they have unlimited and arbitrary power over their fellow citizens, that they can order them to do or not do just about anything under the guise of protecting public health.

We’ve now witnessed local and state governments issue decrees about what people can and cannot buy in stores, arrest parents playing with their children in public parks, yank people off public buses at random, remove basketball rims along with private property, ticket churchgoers, and in one case try—and fail—to chase down a lone runner on an empty beach. All of this, we’re told, is for our own good.

Some Authorities Are Targeting Christians

The most egregious example of this outpouring of authoritarianism was an attempt by Louisville, Kentucky, Mayor Greg Fischer to ban drive-in church services on Easter. On Holy Thursday, one day before Christians were to begin their most important religious celebrations of the year, Fischer declared that drive-in Easter services would be illegal.

To remove all doubt about his seriousness, he also threatened arrest and criminal penalties for anyone who dared violate his order, and in an Orwellian twist, invited people to snitch on their fellow citizens. Fischer justified this by saying it was “to save lives.”

Thankfully, a federal judge made short work of the mayor’s idiotic power-grab, issuing a temporary restraining order against the city of Louisville on Saturday, writing so as to remove all doubt, “The Mayor’s decision is stunning. And it is, ‘beyond all reason,’ unconstitutional.”

The mayor shouldn’t have needed a federal judge to tell him that. Anyone with a passing familiarity with the U.S. Constitution should know the government can’t single out religious worship for special regulations and prohibitions, which is precisely what the clueless Fischer did here. His order would have barred Christians from driving to their church parking lots and sitting in their vehicles for Easter services—all while maintaining proper social distancing—while imposing no such restrictions on drive-up and drive-through restaurants, liquor stores, grocery stores, or parking lots generally.

Mayors or governors—or even presidents—can no more single out Christians on Easter than they can single out Muslims during Ramadan or Jews on Yom Kippur. If you’re going to ban parking in parking lots, it has to apply to everyone everywhere.

But this didn’t just happen in Louisville. Two churches in Greenville, Mississippi, that were holding drive-in services for Holy Week said police showed up and ordered churchgoers to leave or face a $500 fine.

In a video posted on Twitter from Pastor Hamilton of King James Bible Baptist Church in Greenville, a police officer tells Hamilton that because of the governor’s order, “your rights are suspended.” To the good pastor’s credit, he correctly notes that the governor cannot suspend his rights because his rights come from God, not the government.

Pandemic or not, this stuff has no place in American society. Petty tyranny of the kind these mayors and local officials are scheming is wholly alien to our customs and way of life, and destructive to the social contract on which our nation is built.

Thankfully, the Department of Justice has taken notice of this fledgling authoritarian streak among the country’s mayors and governors. A DOJ spokesman said Saturday Attorney General William Barr is “monitoring” government regulation of religious services and may take action against local governments as early as this week.

Overreaching Orders Expose Arbitrary Rule

That’s a good start, but the targeting of churches, while undoubtedly the most offensive overreach by state and local governments, is hardly the only instance of government gone wild. In Michigan, Gov. Gretchen Whitmer has taken it upon herself to declare what items are and are not “essential,” dictating to grocery stores what they can and cannot sell as part of a sweeping order issued Friday.

Among the nonessential, and therefore banned, items are fruit and vegetable plants and seeds. Never mind that growing fruits and vegetables at home right now would help maintain social distancing during the pandemic, the governor has spoken and her word is law. (Lottery tickets, on the other hand, are still permitted.)


Beyond the fruit and vegetable ban, the governor’s order is an object lesson in the absurdity and inconsistency of arbitrary power and rule by fiat. Michiganders are banned from traveling “between residences” if they own a cottage or a summer home, but the ban only applies to Michigan residents, so an out-of-stater with a cottage in the Upper Peninsula could presumably still visit. The ban also still allows travel between states, so if a Michigander has a cottage in Wisconsin or Ohio, he can travel without fear of being arrested or fined by state police.

Why did Whitmer tailor her order this way? Probably because she knows she has no authority to ban travel between states, or issue orders to Americans generally—no more than a mayor has the authority to shut down drive-in Easter services in his city.

That these officials need to be reminded of that, and in some cases restrained by federal judges, bodes very ill for America. Now more than ever, we need leaders who don’t just care about protecting us from the pandemic, but also care about preserving liberty in a time of crisis.

BTW, Governors who shut down their states approval ratings have skyrocketed. Whereas Governors in states like Florida, where DeSantis didn't shut down his state until very recently, have plummeted. Still, approval of most governors’ pandemic response is higher than their baseline approval ratings, suggesting they’re doing something to impress even people who don’t normally approve of them.3 Newsom, for example, isn’t especially popular overall, but he’s getting higher marks for his coronavirus response than just about any other governor for which we have data. Meanwhile, Charlie Baker, the Republican governor of Massachusetts, is also getting good marks for his handling of the virus, but he already had the approval of a large majority of his constituents.

No, the Seasonal Flu is not a "serious health and safety issues".

Flu Lesson: Every Flu Season of every year there are New Different Strains of the Flu. This COVID-19 is a New Different Strain of the Seasonal Flu for this Flu Season which encompasses 2019 - 2020.

Regarding your list of "explanations", you don't know any of that at all. For example, it's very easy to say that people died because they went to a hospital, but you don't have any actual research to back it up. Where's your research to show that if (how many?) people hadn't gone to the hospital, they would have lived? I'm not talking about searching for people on the internet who make that claim. I'm talking about verifiable study results. That's what research is. Where's yours, and specifically on this virus? You have NOTHING. No figures to compare, no research, no NOTHING. It's all just made up stuff, based on a very few cherry-picked snippets of information that you throw out there as evidence of a much larger picture.

As for incentive, does anyone get $40,000 net pay for each of those ventilator patients, especially for the patients who are underinsured? Who? Please explain.

All those people are either on salary, or they get an hourly wage. Did you think they're paid for each patient? They get paid the same, everyday.

Please explain. Who gets the $20,000 per Covid-19 patient, and what reliable source did you get that from?

What about the nursing homes? Do you think it's good for business to have so many deaths from an unchecked virus raging through your facility? If that's the case, are the workers just faking their pleas for protective equipment, not to mention their own deaths?

Speaking of nursing homes, maybe YOU won't be hurt, maybe your immune system is strong, but many others are hurting very bad right now. If you're not in a nursing home, and you don't know anyone in a nursing home, lucky you.

Google it. Just type in, "How is Covid-19 different from a typical flu"? Whatever you believe will be up to you of course, but you might find some new information to base your opinion on. Try to look for a reliable source, something unbiased that doesn't accuse anyone of anything.

Jennifer, I apologize for my lack of clarity, but it wasn't my intention to put words in your mouth. I used that term "crisis actors" because I thought it would be a good example of a ridiculous explanation. My point was that there's really no rational explanation for claims of a hoax. Correction, I got carried away. Some doctors do get paid something for each patient, depending on diagnosis. But I don't believe any lab or lab technician gets paid $20,000 for a positive Covid-19 test. Nor does any doctor or nurse or administrator receive net pay of $20,000 per Covid-19 patient. In fact, if the following information is correct, there's a net loss per COVID-19 hospital patient:

Most COVID-19 patients stay home to recover and don't even go to a hospital (unless/until they feel they have to, because they think they might die if they don't).

Most COVID-19 patients stay home to recover and don't even go to a hospital (unless/until they feel they have to, because they think they might die if they don't).

there are ZERO covid19 patients

until they SHOW that there are covid19 patients.

if you understood the validity of the test
and you obviously don't.
you would understand that claims require proof , not ASSUMPTIONS.

Re banning of sale of seeds. I heard that it was just grass seed that was considered nonessential but vegetable seeds are okay. The gov might have tried to ban everything you can grow yourself in your garden, but that might have changed. I am willing to be corrected on this topic.

In any event, more arguement for seed saving (of heirloom varieties)!

Democratic California Gov. Gavin Newsom is reportedly preparing to close all the beaches in his state after large crowds gathered in Southern California last weekend.

A memo sent to all California police chiefs and obtained by several local news outlets stated that Newsom is set to close the beaches May 1, with no set date for the order to expire.

“All beaches and all state parks in California will be closed, effective Friday, May 1st,” the memo says. “We wanted to give all of our members a heads up about this in order to provide time for you to plan for any situations you might expect as a result, knowing each community has its own dynamics.”

Photos of large crowds gathering at beaches in the southern part of the state generated some controversy on social media over the weekend. A recent study found that of 318 outbreaks in China, just two cases were transmitted outdoors.

Retailers and Malls

Malls and retailers across Texas can reopen but must keep capacity limited to 25%. But for rural counties with five or less confirmed cases of the new coronavirus, retailers can serve up to 50% of their regular capacity.

Areas including food court dining space, play areas and interactive displays must remain closed.

Retailers can also offer customers in-store pick up or get items delivered by mail or to their doorstep.

The task force recommends stores implement either specific pick up times for at-risk customers or that workers take their purchase out to the customer’s car.

Restaurants

On Friday, dine-in service is back on at restaurants but capacity is limited to 25%. But for rural counties with five or less confirmed cases of the new coronavirus, restaurants can serve up to 50% of their regular capacity.

Bars are to remain closed, even if they offer food.

Only six people will be allowed at a table and parties will be seated at least 6 feet apart from each other.

Patrons who choose to dine-in at a restaurant should expect a few new practices: disposable menus, condiments served only upon request and in single-use portions (a side of ketchup instead of a ketchup bottle), buffets that aren’t self serve and a hand sanitizing station at the restaurant entrance.

Valet service is also suspended except for cars with placards or plates for disabled parking.

Restaurants can still provide to-go and delivery service.

Restaurants that reopen dine-in service are encouraged to have an employee open doors to limit how many people come in contact with it and employees should disinfect surfaces and store items.

Movie theaters

Despite the go-ahead to reopen movie theaters at 25% capacity, and 50% in rural counties with five or less confirmed cases of the new coronavirus, some of the state’s largest theater chains said they may not reopen until the summer.

Moviegoers who find an open theater will have to stay at least two empty seats apart from each other and there must be an empty row between customers. If you attend a movie with people you live with you can all sit together but must have two empty seats on either side of the group. If you want to watch a movie with someone you don’t live with, you can sit in the same row but still two seats apart.

Seats and other frequently touched surfaces must be cleaned between each screening.

Theaters with food options must follow similar protocol as restaurants with disposable menus, single-use cutlery and condiments and take home pencils and notepads for places that require customers to write down their order.

Outdoor Sports

Texans can only play sports that don’t include contact with other players and only four people can play at a time. That rules out most sports including basketball, soccer and football. Public swimming pools must remain closed.

The governor’s group noted special instructions for golf courses, which can open. Golf carts must be cleaned between uses, only one person is allowed per cart, unless you’re of the same household and golfers must keep 6 feet apart.

Churches and Places of Worship

Since stay-at-home orders were implemented in early April churches and places of worship have been allowed to stay open as long as they followed social distancing guidelines.

Places of worship can still hold service but the governor’s task force encourages at-risk groups to watch service remotely. Religious institutions should also have designated services or areas for at-risk people who choose to attend in-person service.

Anyone who attends a religious service must sit at least two empty seats apart from other worshippers not in their households, and there should be an empty row between each person.

Museums and Libraries

Public museums and libraries must have permission from their local government to reopen. Once up and running, museums and libraries can only allow 25% capacity and must close interactive areas, like exhibits and play areas. Capacity jumps to 50% in rural counties with five or less confirmed cases of the new coronavirus.


They're probably lying awake at night trying to come up with more dictates for We the People.

And what the heck happens if you break a rule - a fine? Imprisonment?
