Jussie Smollett has been "officially classified as a suspect in a criminal investigation," according to a spokesperson with the Chicago Police Department. The "Empire" actor is accused of filing a false police report, which police say is a Class 4 felony, stemming from an alleged attack in downtown Chicago in late January. Smollett could face jail time.

"Detectives are currently presenting evidence" before a Cook County, Illinois, grand jury, according to a tweet from Chicago Police spokesman Anthony Guglielmi.

Wednesday's new development comes after Smollett's attorneys met with prosecutors and detectives and after detectives said two brothers who were earlier deemed suspects were testifying before a grand jury.

CBS News has learned detectives have been granted about a dozen search warrants to comb through Smollett's bank and cellphone records. CBS News correspondent said Smollett has retained the help of high profile lawyer Mark Geragos, whose clients have included Colin Kaepernick, Chris Brown and Michael Jackson.

CHICAGO — Chicago detectives suspect that “Empire” actor Jussie Smollett filed a false police report when he said he was the victim of a racist, homophobic attack in downtown Chicago late last month, a police official said Wednesday.

Police spokesman Anthony Guglielmi also said Wednesday that detectives and two brothers who were earlier deemed suspects in the Jan. 29 attack were testifying before a grand jury.

Smollett’s attorneys, Todd Pugh and Victor P. Henderson, met with prosecutors and police earlier Wednesday afternoon. It’s unknown what was discussed or whether Smollett attended the meeting. The attorneys didn’t reply to requests seeking comment.

Smollett, who is black and gay and plays Jamal Lyon on the hit Fox TV show, said he was attacked by two masked men at around 2 a.m. on Jan. 29 as he was walking home from a Subway sandwich shop in downtown Chicago. He said they beat him, made racist and homophobic comments and yelled “This is MAGA country” - an apparent reference to President Donald Trump’s campaign slogan, “Make America Great Again” - before looping a rope around his neck and fleeing.

Chicago police on Wednesday said they believe that “Empire” star Jussie Smollett made up claims that he was the target of a racist and homophobic attack — and evidence against him was being presented to a grand jury.

“Case Update: Jussie Smollett is now officially classified as a suspect in a criminal investigation by #ChicagoPolice for filing a false police report (Class 4 felony),” police spokesman Anthony Guglielmi tweeted.

“Detectives are currently presenting evidence before a Cook County Grand Jury.”

Under Illinois law, Smollett, 36, could face up to three years in prison if charged and convicted of the crime.

The announcement followed a stream of recent reports that increasingly cast doubt on Smollett’s story, including that two Nigerian brothers told investigators Smollett paid them $3,500 to stage the Jan. 29 incident.

It also came about 30 minutes after the siblings, Olabinjo and Abimbola Osundairo, were escorted into the grand jury offices at Chicago’s the Leighton Criminal Court Building.

The men were surrounded by about a half-dozen people in civilian clothing as they walked into the secure area on the fourth floor of the courthouse.

On Tuesday, the Osundairos had been about to testify before a grand jury when a last-minute, “Hail Mary” call to the prosecution from Smollett’s lawyers postponed their appearances, according to the local CBS News affiliate.

The defense said it might have new evidence in the case, CBS 2 reported earlier Wednesday.

Smollett, who is black and gay, claims that he was attacked around 2 a.m. near his apartment building in Chicago’s swank Streeterville neighborhood by two men who called him “Empire f—-t n—-r”, doused him with a liquid believed to be bleach and looped a rope around his neck.

Smollett also told detectives that the men shouted “MAGA country,” an apparent reference to President Trump’s signature “Make America Great Again” slogan.

The Osundairo brothers were arrested Feb. 13 but released without charges two days later.

Reports have said they told cops Smollett paid them $3,500 to fake the incident and that he orchestrated the hoax because a supposed death threat he received through the mail a week later didn’t get enough attention.

A report Tuesday said the feds were investigating whether Smollett was behind the alleged death threat mailed to him at the Cinespace Chicago Film Studios, where TV’s “Empire” is shot.

An envelope addressed to him — and with “MAGA” written in the upper left-hand corner — contained a letter that said, “You will die black f-g” and showed a crudely drawn stick figure hanging from a tree.

The envelope also contained a powdery white substance that was determined to be acetaminophen, the active ingredient in Tylenol.

(CNN)"Empire" actor Jussie Smollett was "officially classified" a suspect in a criminal investigation Wednesday for allegedly filing a false police report, according to a tweet from Chicago police spokesman Officer Anthony Guglielmi.

A Cook County grand jury was hearing evidence just weeks after the young actor reported being the victim of a hate crime on January 29, the police spokesman said. Filing a false police report is a Class 4 felony.

Smollett's transformation from victim to suspect in a reported crime that captured national headlines came on the same day that a high-ranking police source said Chicago detectives were working to obtain the actor's financial records.

Investigators also have sought to ask the actor additional questions about the attack.

CNN was reaching out to Smollett's attorneys for comment.

His attorneys met with Cook County prosecutors earlier in the day, according to police spokesman Tom Ahern. But a source close to actor's team told CNN that he has not given police a follow-up interview and no such meeting is scheduled.
Smollett told authorities that two men attacked him, putting a rope around his neck and pouring an unknown chemical substance on him.

The actor denies playing a role in his attack, according to his attorneys.
In a statement before Smollett was named a suspect, 20th Century Fox Television, which produces the series "Empire" on which Smollett appears, and Fox Entertainment expressed support for the actor.

"Jussie Smollett continues to be a consummate professional on set and as we have previously stated, he is not being written out of the show," the statement said.

Two law enforcement sources with knowledge of the investigation have told CNN that police believe Smollett paid two brothers to orchestrate an assault on him.

The brothers, who were arrested and released in connection with the attack, met Tuesday with police and prosecutors at a Chicago courthouse, Ahern said. The county's top prosecutor, Cook County State's Attorney Kim Foxx, has recused herself from the investigation, according to a spokeswoman from her office.
Brothers are cooperating with law enforcement, sources say.

The men -- whom attorney Gloria Schmidt identified as Olabinjo Osundairo and Abimbola Osundairo -- were arrested February 13 but released without charges Friday after police cited the discovery of "new evidence." The two are no longer suspects at this time, Chicago police have said.

In a joint statement issued to CNN affiliate WBBM, the men said: "We are not racist. We are not homophobic, and we are not anti-Trump. We were born and raised in Chicago and are American citizens."
